A previously accident damaged vehicle IS ALWAYS a defective motor vehicle and this is especially true vis a vis the dealer if they did NOT disclose this fact to you at the time of the sale.

Last week we received this query:

“In February 2018 I bought a 2016 second hand BMW motor vehicle from a dealership in Gezina, Pretoria and although I have had satisfactory use of the vehicle for the last four months; I have now discovered that the vehicle which I bought in February 2018 was involved in a major accident last year (March 2017); which required repairs apparently totalling R 127350.00 by the insurance company and I am not happy with keeping this vehicle as that fact was not disclosed to me at the time of the sale in February this year and the dealership must have known about the accident. Is this vehicle defective and can I still claim a refund or replacement vehicle for  the dealer I bought it from?”

 “My husband and I are married out of community of property and without the accrual system in terms of SA Law. For the last ten years, we have both worked together in our family business. Due to health reasons, my involvement in the business is becoming less and less. Our marriage is also going through difficult times, and I am concerned that should we end up getting divorced that I would not be entitled to any share in the future profits of the business which we have built up together.”

If the meter is defective then it is the responsibility of the municipality to not only repair it they would also be liable for the cost of the wasted water.

 Here is the gist of an email inquiry we received last week:

 “Hugh; thank you for taking my earlier call. I live in Newlands in Cape Town and as you know we have severe water restrictions. I’ve really tried to cut down on my water consumption and over the last year, it‘s been very low. However, over the past 4 months my municipal water accounts suddenly more than tripled. Knowing this cannot be right I queried my accounts with the municipality. They said the consumption was correct according to my water meter and I must pay or my water would be cut off. The only explanation I have is that the water meter is not working correctly; but whose responsibility is it to verify this and whose responsibility is the excess water usage if it is defective?”
