Consumer Protection rights

At midnight on that day; that all changed for the better of the consumer

The Consumer Protection Act No 68 of 2008 (CPA).

One of the branches of our law that we, at The Legal Advice Office, try to specialise in, is Consumer Law.

There have been enormous innovations, improvements and new legislation in this field of the law over the last decade.

One of the most important pieces of legislation for the protection of consumers has been the promulgation of The Consumer Protection Act.

Prior to the commencement of The Consumer Protection Act, No 68 0f 2008 (CPA) which came into effect at midnight on the 31st March 2011; consumers had very little defence against abuse by service providers and/or abusive business practices; other than their normal common law or contract law rights.

At midnight on that day; that all changed.

An electronic agreement for the purchase of a house is not currently valid in our law.

We get many varied emails and queries from people all over the country on a daily basis.

Some are straightforward; others really interesting.

At The Legal Advice Office; we received the following query last week

 “I am in the process of purchasing a house in Pretoria, but live in Bloemfontein.

I recently bought my motor vehicle by merely signing certain online documentation electronically, and it was so quick and easy to complete. I asked the estate agent in Pretoria who is acting for the seller if I can use the same technology to purchase the house, but she said that the contract won’t be valid if I sign it electronically. Is this true? Please, could you advise me?”

Landlords and their agents often refer to an early cancellation of a lease agreement by the tenant as “a breach of contract.” This is not the case.

Here is a recent query that was received by The Legal Advice Office last week:

“Hi, Hugh. My company is the tenant in a Commercial Property in Centurion. We were led to believe by the landlord’s agent that the foot traffic in our new Mall would be considerable, but this is simply not the case. The Mall parking is incomplete as is the final building completion and promises made to us at the time of the negotiations with the agents for the lease have simply not materialised. We feel that we were misled into signing this lease for 5 years and still have 4 years and six months to run and are simply not able to keep afloat as we have run at a loss for the last 6 months. Is there any advice you can give us to assist us in terminating this lease?”
